Customer Service Agreement

This is an agreement between koaladigital.com and you, the customer regarding the use of it's computer, information, communication and server management service. This agreement governs the terms and conditions under which koaladigital.com makes the services offered by koaladigital.com to each customer through a personal computer or any similar devices. You must comply with the Acceptable use policy provided by koaladigital.com.

koaladigital.com will host the account for the purchaser, you (and hereafter refered to the Account Owner) for the Account Owner's chosen domain name and for the Term corresponding with the payment plan chosen by the Account Owner. The contract will be renewed automatically at the end of the Term, unless terminated with notification by fax or postal mail with a min of 30 prior notice to the renewal date. Email and cancelation by phone is not acceptable. If none of this was provided, a cancelation change of $90 will apply to the Account Owner.

koaladigital.com disclaims any representation or warranty that the koaladigital.com services will be error-free, secure or uninterrupted and will not be responsible for any damages your business may suffer. koaladigital.com reserves the right to refuse service if any of the content within (including images / pornography / text), or any links from, the Account Owner's website is deemed illegal, misleading, or obscene, in the sole and absolute opinion of koaladigital.com. Notwithstanding anything in this Agreement, the content of the Account Owner's website is the sole responsibility of the Account Owner. koaladigital.com disclaims any and all service interruptions caused by koaladigital.com and its employees. koaladigital.com reserves the right to revise its policies at any time.

koaladigital.com reserves the right to change the prices to the Account Owner at anytime for any services koaladigital.com provides.

The Account Owner agrees to follow the rules of Netiquette for email messaging and news group posting. The Account Owner is responsible for the passwords. koaladigital.com will not change any passwords without proof of identification.

The Account Owner agrees not to harm koaladigital.com. This includes it's reputation, computer systems, programing and other persons using koaladigital.com's services. The Account Owner understands that the services provided are on a shared server and cannot be permitted to overwhelm the server with heavy CPU utilization. If any of the other users have complained due to heavy CPU utilization, you will need to relocate the web site and koaladigital.com will refund the portion of the unused services. In failiure to comply will result to termination of the Account Owner without refund to the unused portion of the unused services

The Account Owner's rights and privieges under this agreement cannot be sold or transfered without acknowlegement of koaladigital.com

If the Account Owner sells or resells advertising or web space to the third party, the Account Owner will be responsible to uphold the Agreement of koaladigital.com to the third party.

This Agreement applies to all account, sub-account and alternative account names associated with your principle account. The Account owner is reponsible for use of each account. In the event of a breach of security through the Account Owner's account, the Account Owner will be liable for any unauthorized use of the koaladigital.com services, including any damages resulting therefrom, until the Account Owner notifies koaladigital.com's customer service.

The Account Owner agrees to indemnify and hold koaladigital.com harmless from any and all Claims resulting from or connected with any activities conducted by the Account Owner. The Account Owner and koaladigital.com will promptly notify the other upon receipt of any Claim or legal action arising out of activities conducted pursuant to this Agreement. The rights and responsibilities established in this paragraph will survive any termination of this Agreement.

This Agreement shall be governed by the provincial and federal laws of Canada. Canada will have exclusive jurisdiction over all such actions.
